Terms and Conditions / Privacy

These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below with Berkshire’s Dogs on Raw. These terms and conditions does not affect the customer’s statutory rights.

All prices on the site are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT).

You must be 18 years or over to use this website.

Privacy Statement

We are committed to protecting your privacy. If you have any questions about our privacy policy, the information we hold about you, want to stop receiving marketing-related information from us, or think that information we hold about you needs to be updated or corrected, please send an email to hazel@berkshiresdogsonraw.co.uk

Any details that you give us via our website may be added to our database. The database is used by us (and third parties acting on our behalf) for client administration and marketing-related purposes. We may, from time to time, send you mailings that you have requested or we feel may be of interest to your and/or your business. Such mailings may include details of our services, newsletters, updates and invitations events. We do not rent, sell or disclose your contact details to any other third parties.

Confidentiality

In accordance with the Data Protection Act 1998 you have the right to access any information that we hold relating to you, on the proviso that we are given reasonable notice of such a request. Client records are regarded as confidential and therefore will not be divulged to any third party, other than our manufacturer/supplier(s) and if legally required to do so to the appropriate authorities.

Exclusions and Limitations

The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law, this Company:

  • excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

Log Files

We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Like most interactive websites, we use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting.

Payment

We accept online payment in a secure environment by credit/debit card. All goods remain the property of the Company until paid for in full. Monies that remains outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England’s base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuing institution refuses to authorise payment to us we will not dispatch the goods and will not be liable for any delay or non delivery of orders.

Cancellation Policy

For you to cancel an order a minimum of 24 hours notice is required. Notification for instance via email, mobile phone ‘text message’ or any other means will be accepted subject to confirmation in writing. We reserve the right to levy a £30 charge to cover any subsequent administrative expenses.

We reserve the right to cancel the contract between us if we have insufficient stock to complete the order, we do not deliver to your area or the goods you ordered were listed at an incorrect price due to a typographical error.

If we do cancel your contract we will notify you by email and will credit your account within 30 days of your order, if you do not wish to place an alternative order. We will not be obliged to offer any additional compensation for disappointment suffered.

Refunds Policy

Due to hygiene reasons, we are unable to accept the return or exchange of any frozen foods unless they are unfit for purpose, incorrect quantity or deemed unsafe in any way. If you have a problem with any of our products, please contact hazel@berkshiresdogsonraw.co.uk within 2 working days of the delivery of the goods in question.

If you notify a complaint or problem to us, our obligation will be either:-

  • To make good any shortage or non delivery.
  • To replace any damaged or defective good, unless that would be disproportionate; or
  • To reduce the purchase price by an appropriate amount; or
  • To refund to you the amount paid by you for the goods in question.

Unsatisfactory goods will be be collected.

We will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising out of any problem you notify us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you some or all amount paid by you for the goods in question.

Responsibilities of the Customer

It is the responsibility of the customer to ensure that all information given on your order form is complete and accurate. Where information given by the customer is incomplete, misleading or incorrect the customer will be liable for any costs involved in resolving the matter.

Availability

Unless otherwise stated, the services featured on this website are only available within the United Kingdom, or in relation to postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Events beyond our control

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our news page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our website 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis

Delivery

Please note, we only deliver in the  following postcodes: RG14, RG17, RG18, RG19, RG20 at the moment and customers need to be in for delivery. If you are not home, then your order will be left on your doorstep, which will be at your own risk. Delivery days are shown at checkout for you to select your preferred delivery day and time.  There is a delivery charge of £1.50.

Deliveries will be made at our risk by us. If we cannot deliver the goods to you within the timescales requested then we shall endeavor to contact you as soon as possible with an update and if you are not satisfied then we shall offer you a full refund. Please note that dates quoted for delivery of goods are estimates. We will not accept any responsibility for any failure to deliver goods or delay, damage or defect caused in doing so if the circumstances were beyond our reasonable control.

Governing Law

The contract between us shall be governed by and interpreted by English law and the English Courts shall have jurisdiction to resolve any disputes between us.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
